SECURITY SYSTEMS NEWS JUNE 2011 www.securitysystemsnews.com RESIDENTIAL SYSTEMS 35 Judge upholds termination of NYMP president By Tess Nacelewicz FREEPORT, N.Y.—A federal judge in early May upheld the firing of Wayne Wahrsager from his job as president of New York Merchants Protective Co., Inc. (NYMP). The date of the termination was April 15, the day that the court- appointed receiver now running the debt-ridden NYMP filed a letter with the court saying Wahrsager refused to leave despite being fired. However, the judge in his May 2 ruling gave Wahrsager until May 13 to vacate the premises of the alarm company, based here. The delay was Pro 1 Continued from page 34 modern technology, Haenggi said. Both service enhancements still rely on it—she said Tech Tracker sends out information about tech- nicians electronically, and when customers call in to speak to a real company representative instead of a recording, technology helps identify them automatically and route them to customer service or monitoring, depending on their alarm status. “We’re using significant tech- nology on the back end,” Haenggi said. “We love technology, but not when it comes between us and our customers.” She said it was CEO Whall’s idea to eliminate automated attendant phone service. “His passion is to deliver just the best customer ser- vice,” Haenggi said. “One of the things he actually has said before is, ‘I hate the drone’ [the automated attendant]... and we’re all kind of saying, ‘Well, nobody likes it,’ and he said, ‘Well, we shouldn’t have it.’” Protection 1 eliminated the automatic phone attendant in November, Haenggi said. Both initiatives tell custom- ers that Protection 1 respects their time, Haenggi said. Tech Tracker was rolled out nationally earlier this spring. Sending extra information about the technician and the person’s photo helps custom- ers feel more secure, but it’s also a personal touch, Haenggi told SSN. “I know what you look like before you get here, so when I open the door I kind of know you already,” she said. Haenggi said customer feed- back on Tech Tracker in a couple months of use “has just been overwhelmingly positive.” Protection 1 serves more than 1 million customers and employs more than 2,500 peo- ple in more than 60 locations across the nation. SSN so Wahrsager can separate Senior Care 911, a PERS business he runs from the same building, from NYMP operations, the judge said. The judge ordered Wahrsager— whom the receiver characterized as a disruptive influence at NYMP—not to interfere with the company’s operations. “I find that the receiver will be significantly impeded in doing his job unless Wahrsager is directed to remain away from the work site during the pendency of the receivership,” the judge wrote. Wahrsager, who has contended the receiver is grossly mismanaging his company, did not return a call by Security System News by deadline. The judge’s ruling was the latest twist in a civil lawsuit filed in U.S. District Court in New York by Bank of America on Jan. 5 of this year against NYMP. Bank of America charged NYMP with breach of contract regarding a $17.5 million loan. Bank of America said it was owed more than $19.2 million, and sought the appointment of a receiver to protect the assets of NYMP, a full-service alarm company serving New York and New Jersey of which Wahrsager is a principal. According to court records, Bank of America contends NYMP and oth- ers committed fraud “via the kiting of checks and overstating NYMP’s monthly revenue.” Wahrsager has told SSN he agreed to a receiver to help resolve NYMP’s debt problems but he has since accused the receiver of causing “stag- gering waste and losses” over the last few months at NYMP, a longtime family business.
