BUSINESS 20 | Overdrive | July 2014 After closing last month, New Century Transportation was hit with a class-action lawsuit filed by driver Robert Kearney. He alleges the company violated federal law by not giving drivers a written notice 60 days prior to their dismissal. Kearney's suit says the company violated the feder- al Worker Adjustment and Retraining Notification (WARN) Act and New Jersey's Millville Dallas Airmotive Plant Job Loss Notification Act. Kearny is seeking for himself and other drivers 60 days of wages and benefits and severance pay for lost wages that's equal to one week of pay for each full year of employment. New Century filed for Chapter 7 bankruptcy in New Jersey. The Mount Holly, N.J.-based company had about 1,500 employees, and they were terminated June 9, court docu- ments say. New Century had about 1,000 drivers and 1,000 power units. The company hauled general freight nationwide and had $273 million in revenue in 2012. – James Jaillet Driver lawsuit follows New Century bankruptcy PARTNERS IN BUSINESS TIP: BE WARY OF EASY INSURANCE SIGNUPS Don't automatically include insurance in the final contract of a truck loan. Shop first, and you might opt to buy it elsewhere. Also, don't sign up for credit life or credit disabil- ity insurance, which covers your truck payments if you die or become disabled. You likely can get the same type of policy on your own at a much lower rate. The Partners in Business program is produced by Overdrive and the consultants at ATBS, the nation's largest owner-operator business ser- vices firm. It is sponsored by Ryder and Goodyear. The next Partners in Business seminars will be Aug. 22 and Aug. 23 at the Great American Trucking Show in Dallas. The Partners in Business manual can be ordered through eTruckerStore.com. PILOT FLYING J and Trucking Moves America Forward announced a five- year partnership in which the truck stop chain committed $1.25 million to help grow the advocacy movement over five years. TRANSFORCE of Saint-Laurent, Quebec, agreed to acquire Eagan, Minn.- based dry van truckload carrier Transport America from Goldner Hawn Johnson & Morrison for $310 million. CON-WAY TRUCKLOAD ordered 550 new tractors, all equipped with 6x4 axles and nearly all equipped with automatic transmissions. MACK TRUCKS updat- ed its macktrucks.com website and optimized its design for mobile devices. It also soon will have a forum where customers can submit questions to Mack and upload photos of their trucks. A $26 million upgrade to the Mack Trucks assembly plant in Macungie, Pa., will "improve the plant's efficiency and help it deliver even higher quality trucks," the truck and engine maker announced.
