29 Oil Prophets LEGAL CORNER use and requirements of using seatbelts as a part of their work, and they are then injured in a work-related accident because they weren't wearing a seatbelt, one of those limited exceptions I referred to above may come into play where such failure can rise to the level of what is deemed willful misconduct, i.e. or willful failure to use a safety device and may be a defense to paying that claim. This article is not the time or the place to get too deep into particulars like that, but this example just reinforces the importance of a quality, active, and in fact ongoing loss control program within your company. Other things like having surveillance cameras throughout your business facilities can be vital in protecting you against fraudulent work comp claims. As most of you know, and if you don't, you should know, that for 25 years, the Alabama Workers' Compensation Self Insurance Fund or "AlaCOMP" has been your Association-sponsored workers' compensation program. It was formed by P&CMA's predecessor, the Alabama Oilmen's Association, in 1992. I work closely with the people at AlaCOMP and their adjusting firm, Business Insurance Group, and can tell you they do have a quality loss control program. If you are with AlaCOMP already, please take full advantage of those loss control services. It can save you real money down the road. One bad claim can be disastrous to your work comp premium and your ability to get workers' compensation insurance at a competitive price. If you can avoid that bad claim by putting in place and keeping in place a quality loss control program, then you've done yourself and your company well. I know AlaCOMP would say to call them if you have questions about any of the services they provide even as an existing insured in that program or someone needing coverage or considering a change in their carrier.
