England plans to appeal fraud ruling C.R. England plans to appeal a federal judge's class certification of a case alleging fraud, a ruling that could result in thousands of owner-operators joining the two independent contrac- tors in the 2012 lawsuit. Judge Robert J. Shelby for the District of Utah in late January gave permission to allow the suit against the refrigerated carrier to proceed as a class action lawsuit. It gives plaintiffs 30 days to prepare a final plan for notice to class members. "We vigorously dispute the allega- tions made in this case and disagree with the court's decision to certify a class," said T.J. England, chief legal of- ficer for the Salt Lake City-based fleet. "We intend to immediately appeal." Plaintiffs allege fraud and other statutory claims against C.R. England and its related company, Opportunity Leasing Inc., which operates under the name Horizon Truck Sales and Leasing. Horizon's primary purpose is to lease trucks to drivers who work as independent contractors affiliated with C.R. England. Plaintiffs Charles Roberts and Kenneth McKay say the companies recruit students to C.R. England's driver training schools with promises that they can become a company driver or enjoy strong earnings as an independent contractor. But truckers say company driver positions were largely unavailable and allege driving school students were subject to a misinformation campaign to entice them to lease trucks from C.R. Inland Kenworth designed the truck, which is equipped with a 76-inch sleeper, a 485-hp Paccar MX-13 and an Eaton-Fuller 10-speed automated. Equipment auction company Ritchie Bros. will auction the truck as its June 20 Phoenix auction. 2016 WAS THE DEADLIEST year on U.S. roads since 2007 if a preliminary report from the National Safety Council holds true. It shows 40,200 fatalities, a 6 percent increase over 2015, with no breakdown of truck-related deaths. The group also estimated a rate of 1.25 deaths per 100 million vehicle miles traveled, a 3 percent increase over 2015. FOUR OPIOIDS have been proposed by the U.S. Department of Transporta- tion for addition to the list of drugs that drivers must be screened for during urine analysis tests. The commonly abused pain medications are hydrocodone, oxycodone, oxymorphone and hydro- morphone.
