Yearout Mechanical, Inc., No. 08-225, 10th Cir., NM, 2010); but they typically honor acknowledge- ments that customers have received all proper instructions and warnings. Although some of these provisions can appear to overlap, they rarely do from a legal standpoint (and redundancy almost never hurts in such cases). Conclusion It appears the New York Appeals Court opened Pandora's Box back in 1852 with its decision in the Winchester case, and that the state courts, particularly California's, have since pried the lid off and thrown it away. Given that there appears to be no end to the expansion of products liability lawsuits in sight, equipment lessors need more than ever to use every tool at their disposal to limit or eliminate claims and deflect (away from themselves) as much potential liability as possible. Incorporating and buying insurance used to be enough for most lessors. More recently, however, the rental contract has become a crucial additional safeguard against this, and many other types of liability. n JAMES R.
