LOGBOOK February 2018 | Overdrive | 19 Stevens Transport has agreed to pay $54,000 to a driver whom the com- pany allegedly denied employment in 2016. In the original lawsuit fi led in November 2016, the U.S. Equal Employment Opportunity Com- mission claimed Stevens wrongfully denied employment to Brian Brown, a U.S. Air Force veteran, because of the medication he took for his bipolar disorder. EEOC said Brown had documenta- tion from his medical provider stating he was safe to drive, but the doctor Stevens Transport used to do medical exams told Brown he could not be hired while on the medication. The Dallas-based fl eet responded to the lawsuit the next month, stating Brown didn't complete the application process, including his U.S. Department of Transportation physical, and was not qualifi ed for the position. Stevens added in its response that its indepen- dent doctor said Brown "created a substantial risk to the motoring public." As part of the settlement, Stevens agreed to conduct annual training on the Americans with Disabilities Act and not automatically disqualify ap- plicants based on their use of certain medications that aren't disqualifying under DOT regulations. – Matt Cole FLEET TO PAY DRIVER $54,000 TO SETTLE LAWSUIT As part of the settlement, Stevens Transport agreed to conduct annual training on the Ameri- cans with Disabilities Act. The 34 drivers at the former Con-way Freight location seek to join XPO freight workers in seven other locations who already have joined the union. The most common toll for a Class 8 truck increased from $23.60 to $25.01 for E-ZPass and from $33.10 to $35.08 for cash.
