March 2018 | Overdrive | 15 States consider measures to block ELD mandate Legislators in South Dakota, Missouri, Tennessee and Idaho have introduced proposals to stymie enforcement of the electronic logging device mandate, either by suspending funds for enforcement or by asking the federal government to reconsider the mandate that took effect Dec. 18. The bills mostly cite concerns of small-business truckers as the reasons to repeal the mandate or suspend its enforcement. South Dakota and Missouri have called for an outright repeal of the mandate. South Dakota lawmakers cite the cost of compliance, privacy issues and the Federal Motor Carrier Safety Administration's self-cer- tified device registry. One Missouri General Assembly bill asks Congress to repeal the mandate. The other forbids state personnel from en- forcing the mandate and forbids them from keeping or transmit- ting records of noncompliance. The Tennessee Senate intro- duced a bill that would prohibit state funds from being used to enforce the mandate. The bills in Missouri and Tennessee had seen no action at press time. Both chambers of the Idaho Legislature introduced a joint resolution that would perma- nently exempt agriculture and livestock carriers domiciled in the state from complying with the mandate.
