32 tobaccoasia PRODUCT NEWS 产品新闻 adding that the most notable was nicotine salts in e-cigarettes. "We know that when you smoke a tobacco product, it's a very efficient way to deliver nicotine across the blood-brain barrier. So, it's been very difficult to rival that efficiency in another product. But in the case of nicotine salts you have the potential to more efficiently deliver nicotine which could hold some public health promise in terms of giving smokers enough nicotine that they would transition completely. But you also have to consider the opposite side of the coin, which is the inherent risks of initiation among youth. So I do worry about that." "So there's a lot happening and I think that it could be promise or peril. But I think it's important that the science drives that." FDA's "Significant Progress" on Synthetic Nicotine The US Food and Drug Administration (FDA) said it is making "significant progress" processing and reviewing premarket applications for non-tobacco nicotine products. The agency said all applications submitted by the May 14 deadline had been handled and that more than 85% had been reviewed to see if they met the minimum requirements to be accepted for further review. Refuse-to-accept (RTA) letters were issued for more than 800,000 new non-tobacco nicotine (NTN) products in applications that did not meet the requirements for acceptance, including more than 700,000 new RTAs since August 3. The RTA letters declare that it is illegal to sell or distribute any new tobacco product in the US market without first obtaining premarket authorization. Nearly one million NTN applica- tions from more than 200 distinct companies, according to the FDA, were submitted by May 14. FDA said that multiple steps are involved in getting these applications ready for review, and that the organization, size, and quality of the data submitted vary greatly. This has an impact on how long it takes to process the data. Over 350 applications for NTN goods have been approved by the agency in total, with e-cigarette and e-liquid items making up the majority of those applications. According to FDA, acceptance is not a determination of the products' authorization status. Accepted applications will go through another review, which ensures that a number of requirements are satisfied. FDA has sent 44 warning letters to manufacturers and more than 300 warning letters to retailers for NTN product violations. According to FDA, additional measures such as civil monetary fines, seizure, and/or injunc- tions may be taken if infractions are not promptly corrected. These figures include 25 new letters of warning sent to NTN product manufacturers since August 3 for promoting their goods without the necessary premarket approval. These manufacturers neglected to file applica- tions for their NTN products. Also, 102 retailers received new warning letters from FDA for selling NTN products to underage purchasers. Judge Rules Against Flavored Tobacco Ban Adults over 21 in Washington County, OR can still purchase flavored nicotine products after a judge ruled against the county's 2021 ban on such products. Circuit judge Andrew Erwin said state law preempts the ban, writing in his opinion, "the decision to disallow licensed retail sale of such products must come from the state, not county by county. Certainly, the county has broad power to regulate how sales are made, but they cannot bar them entirely." Washington County commission- ers voted to outlaw the goods in November of last year to reduce the use of nicotine by teenagers and young people, asserting it had the authority to enact the local ban under Senate Bill 587, a 2021 law that gave public health agencies power to regulate tobacco sales. The flavored tobacco ban, a first in Oregon, went into effect in January but was never enforced. Habanos, S.A.
