LEGAL CORNER Single Hose, Labeling and Other Issues cheaper blended product. This has its roots in the concerns over a customer seeing one price for a product on the price sign and then getting to the pump and the price is something different, i.e. higher. Regulators have forever been concerned over what they see as essentially a "bait and switch" tactic. This is no different than requiring similar "explanatory" language if you're posting one price for cash and a higher price for credit. Apparently, the Department has had a few – I contend extremely rare – instances where a customer pumps conventional fuel thinking they're pumping blended fuel and they go to pay and it's 20 cents a gallon higher than they thought. There is no doubt these regulatory issues will continue to grow as the demand for unblended product grows, and more marketers choose to make it available to their customers. At a minimum, it is our hope that our relationship with the Department will avoid a "red tag" if the Department inspector finds problems with your product labeling and will give you an opportunity to correct it. As always, if you have any questions about these and the many other related issues to marketing both blended and unblended product, feel free to call the Association office or me at (334)264-0400.
