PMAA opposed the provision in written com- ments, asserting that it would have reduced the already shrinking number of new drivers by establishing unnecessary regulatory barriers to CDL qualification. Not the least of these barriers is the added cost that entry level drivers would be required to pay in order to obtain a CDL, PMAA said. PMAA told the FMCSA that there is currently no scientific basis demonstrat- ing that minimum hours based BTW training program leads to more profi- cient drivers. PMAA pointed out that adopting an hours-based BTW mandate violates Executive Orders 12866 and 13563 and Office of Management and Budget (OMB) directives that federal agencies give preference to rules based on performance standards. According to these directives, "performance standards give the regulated parties the flexibility to achieve regulatory objectives in the most cost-effective way." "The minimum hour BTW require- ment was the most onerous provision in the NPRM from our perspective and we are happy the FMCSA heard our concerns," PMAA said. The association said it supported a performance-based standardized core curriculum for CDL drivers in the final rule because it will lead to safer and more professional driv- ers while allowing trainers to offer more industry specific training as needed. PMAA said it believes the FMCSA came up with a final rule that implemented the changes to entry level driver training mandated by Congress while offering a significant flexibility that won't act as a deterrent to new CDL applicants. INGALSBE, CEO OF INDEPENDENT TECHNOLOGIES, DIES IN PLANE CRASH Daryl E. Ingalsbe, president and CEO of Independent Technologies, Inc., died in a plane crash near his home in Spruce Creek, Fla., on Dec. 27, the company announced. "We offer our sincerest condolences and prayers to Daryl's family, friends and his family of employees," the company said in a statement. "We also offer our sincerest condolences and prayers to the family and friends of his very good friend, Deb Solsrud of New London, Minnesota." Ms. Solsrud also died in the crash, the company said. The Independent Technologies, Inc. board of directors has appointed Vice President Hank L. Smith as the president and CEO. A statement released by the board declared, "All of us at Independent Technologies have lost not only a great innovative leader in the voice and data communications research and devel- opment field, but we have also lost a close friend. We will carry on his vision and continue to make Independent Technologies the market leader in all of our industrial disciplines." P r i o r t o j o i n i n g I n d e p e n d e n t Technologies in 1992, Smith worked for US West in various technical and man- agement positions for over 20 years. He has a BA and MBA in finance from the University of Nebraska and an Electrical Technology degree from North Dakota State School of Science. Independent Technologies is based in Blair, Neb.
