States use these as a starting point but also have the right to be stricter than federal law. At the national level, the U.S. Environmental Protection Agency (EPA) regulates the use of pesticides under the mandate of the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA). According to the FIFRA, users cannot use any pesticide in a manner that is inconsistent with the label. For example, they can only use a product on sites that appear on the label. In addition, this provision means the product can't be used at a rate that is greater than that specified on the label. At the same time, using a product at less than label rates may encourage the development of resistance of the pests to the pesticide. While the penalties for not following the label vary by state, failure to follow label directions can at the least result in a fine ($5,000 to $10,000 per offense) and could even include mandatory jail time.
