FIVE PEOPLE were found guilty in U.S. District Court in Brooklyn, N.Y., in connection with a widespread fraudulent commercial driver's license test-taking scheme that took place at five test centers. Conspiring CDL applicants paid facilitators between $1,800 and $2,500 for pencils with encoded miniaturized test answers and a Blue- tooth headset to use as a communications device with an external test-taker. A DRUG TEST collection agency owner in Tyler, Texas, was sentenced to perform 40 hours of community service and pay $2,790 in restitution for submitting false documents to the Federal Motor Carrier Safety Administration. Andy Garr, owner of Compliance Ser- vices of East Texas, would forge drug test results by using letterhead from the lab and falsifying the doc- tor's signature. AN ALABAMA TRUCKING company was ordered last month to pay $113,000 in back wages and damages following an investigation by the U.S. Labor Department. DOL investigators found that Fitzhugh Contracting, a log- ging and trucking contractor based in Gallion, violated the overtime and record- keeping provisions of the Fair Labor Standards Act. A NEW HAMPSHIRE MAN was indicted in U.S. District Court on July 29 and charged with four counts of illegally transporting hazardous ma- terials without a commercial driver's license, hazmat endorsement, placards or shipping papers. Lewis Niles of Whitefield was charged with transporting more than 2,400 gallons of flammable liquids in plastic totes. A TRUCK DRIVER was sentenced to 20 years and 10 months in federal prison without parole after pleading guilty to transporting a minor across state lines for prostitution. Tony Eugene Wadlow, 56, of St. Joseph, Mo., a self-employed driver doing business as Prideco LLC, is a registered sex offender who was convicted in 1997 of sex-related charges. He also has prior felony convictions for being a felon in posses- sion of firearms and possess- ing methamphetamine.
