T I C K E T S NO MEMBERSHIP FEES NO MONTHLY DUES MOVING AND NON-MOVING 844-784-6384 INTERSTATE TRUCKER LTD. © www.interstatetrucker.com Follow us on LEGAL LANE 28 // COMPANY DRIVER // SEPTEMBER 2016 this 'friend' based upon the statute of limita- tions, your standing to sue, and what jurisdic- tion you will have to fi le the suit. It may be that you must fi le the suit in another county or state, and that can add extra legal fees as well as additional stress on you. Fourth, do you have the time and money to pay a lawyer to handle the lawsuit? Lawsuits can get expensive, and you sure do not want to spend more money on the lawyer than the trailer is worth. Keep in mind a lawsuit will take up your time and energy and limit the amount of work you can do to make money. The lost income may be the same as the value of the trailer. Fifth, is your claim small enough for "small claims" court? Each state has their own vari- ation of "small claims," where usually the suite is for $5,000 or less and they will allow you to represent yourself in court, but you can still hire an attorney if you want to. My advice to you is to talk with him and try to come to some compromise about this issue. However, if this is the only trailer in the world that will work for your son, then you have no choice but to seek its return. You should only sue your 'friend' if you want to lose his friendship, and he leaves you no other option. CD Jim C.
