On Sept. 2, 2011, Olegs Kozacenko, 57, says he was attacked by troopers without provocation while he was reading their citation for exceeding the hours of service limit. The officers repeatedly punched the trucker, then used a Taser, Kozacenko's lawsuit states. The officers repeatedly pushed his head against the pavement, resulting in significant traumatic brain injury. They also left him with multiple fractures, according to court documents. Last March, both parties agreed to mediation, and the court dismissed the lawsuit Oct. 22. Information on the settlement was not released. Kozacenko became a U.S. citizen and earned his CDL after emigrating from Rus- sia. THE CDL DRUG AND ALCOHOL clearinghouse final rule is project- ed to be sent to the White House Office of Management and Budget in March and not published until mid-June. The rule will establish a database of CDL holders who have failed or refused a drug test and require carriers to update the database and query it when hiring drivers. TENNESSEE is the best state to own a small trucking company, while California is the worst, according to a survey of 3,287 individuals in trucking by alterna- tive financing firm Merchant Cash USA. Questions involved parking costs, friendliness to drivers and state fees and rules. Washington was the second-best state, fol- lowed by Oklahoma, Texas and In- diana.
