The CRA also places additional restrictions upon the Senate procedure for disapproval, further streamlining the process compared to regular legislative action. The Senate can speed the resolution through committee consideration, and once submitted to the Senate, the CRA only affords 10 hours to debate the joint resolution without the option to filibuster. 5 U.S.C. §§ 802(c), (d). The resolution must be voted upon immediately following the debate and remains unfinished business of the Senate until voted upon. The in- ability to filibuster prevents vocal minorities in the Senate from stalling the joint resolution. Despite the measures included in the CRA to fast-track joint proposals for disapproval, only one rule has been disapproved under the CRA since its inception in 1996. In 2001, incoming President George W. Bush disapproved the OSHA ergonomics rule promulgated by the Clinton admin- istration. The scarcity of successful implementation of the CRA comes from its requirement that a majority of both houses and the president must ratify any disapproval of a rule unless two-thirds of Congress agrees to pass the joint resolution. Since a rule is generally promulgated by the President's administrative agencies, a joint proposal is most likely to succeed when an incoming president considers a regulation promulgated by the previous administration. Although its procedure differs from normal legislative action and provides some advantages, the CRA does not provide a drastic impediment for rules promulgated dur- ing midnight of an outgoing administration. Congress can simply pass a law through the normal legislative process to disapprove a rule if it has a majority of votes in both houses and a sympathetic president, or the new administration, could undertake rulemaking to do so. Despite frequent ref- erences to the CRA leading up to an election, it is unlikely to nullify any midnight rules passed by federal agencies. The CRA is not a "silver bullet" for Congress to control rulemaking, but it does streamline the process when an in- coming Congress and President are allied. If Republicans win control of Congress and the presidency in the upcoming elec- tion, the government may use the CRA to speed its process of disapproving rules. Removing regulations, however, is a dif- ficult task for the federal government that requires the same amount of support as normal legislative activity, and it is un- likely to remove any of MSHA's rules that are finalized before Jan. 20, 2017, even if those rules fall within the 60-session day window that allows congressional review.
