Such reviews have been recommended by overseas regulators in the United Kingdom, the report notes. After reviewing local, state, and federal rules and regulations, and examining the capabilities of regulators, the CSB investigation team determined that Cal/OSHA is under-resourced to adequately oversee the refinery industry in California. The report notes that between 2006 and the date of the August 2012 Chevron accident, Cal/OSHA conducted three planned inspections of the Richmond refinery, totaling only 150 inspector hours of effort. The report contrasted those inspections with federal OSHA refinery National Emphasis Program inspections between 2007 and 2011 that lasted roughly 1,000 inspector hours. When federal OSHA established its Process Safety Management or PSM standard in 1992, even more intensive Program Quality Verification facility audits were planned, but these were rarely done due to inadequate resources. The investigation team will report further on this and other related regulatory issues in its final report scheduled for later in 2013. Court Rules Against Work Truck Certification Challenge The Sixth Circuit Court disagreed with the NTEA's (Farmington Hills, Mich.) appeal to a recent rulemaking by the National Highway Traffic Safety Administration (NHTSA) on new roof crush standards. The NTEA's challenge was based on a very technical legal aspect of the rule that the association asserted could leave certain multi-stage manufacturers without a defensible path to proper certification. The court's ruling should not affect the work being done by a multi-stage manufacturer on a day-to-day basis. EPA Releases March Biodiesel Figures The EPA reported that 109 million gallons of biodiesel were produced in March. Biodiesel, an EPA-designated Advanced Biofuel that has exceeded targets under the Renewable Fuel Standard (RFS) for two consecutive years, is reported under the Biomass-based Diesel category under the RFS. The numbers show a total of more than 127 million gallons of Biomassbased Diesel for March, but that total also includes production of renewable diesel. With the March numbers, year-to-date biodiesel production stands at just under 259 million gallons. Made from an increasingly diverse mix of resources such as recycled cooking oil, soybean oil and animal fats, biodiesel is the first and only EPA-designated Advanced Biofuel that's produced on a commercial scale across the U.S. It is produced in nearly every state in the country and is used in existing diesel engines without modification.
