LEGAL CORNER 6. 6 It defines the terms "kerosene" and "K-1 kerosene" to eliminate confusion over the historical use of those terms in both the state and federal tax codes, and it was believed definitions were appropriate because the technical corrections also made K-1 kerosene refined in this state for immediate export exempt from the destination state taxes. Hopefully, we continue to work out – or have worked out – the "kinks" with moving the State excise tax collection point to the terminal rack. As we've reported throughout this process over the last several years, every state that moved the collection point to the terminal rack, said they would never go back to doing it the old way. Also, you will remember that this legislation was not the idea of P&CMA, but when it became clear that the Legislature, with the active support of the current Administration were all behind this, and that it was coming whether we liked it or not, we undertook to get it passed on terms most favorable to us. We believe at the end of the day we've accomplished that and hopefully our members will benefit from it going forward.
