Sergio Tristan Maldonaldo, also known as Tristan Transfer, has the option of requesting administrative review of FMCSA's Jan. 23 decision that could return the carri- er to the program it entered in July. The two-truck, five-driver carrier received a conditional rating during a Dec. 20 compliance review and was given until Jan. 19 to correct issues to avoid revocation. It failed to present proof of correction to FMCSA by that time. The agency noted a dozen safety management control vio- lations, such as noncompliance with the hours of service rule and not requiring a driver to make a record of duty status. Other problems included driver alcohol and drug data. Tristan had used a driver or drivers before receiving a nega- tive pre-employment controlled substance test result. It also had failed to investigate a driver's alcohol and controlled sub- stances history for three years. FMCSA also had noted problems during inspections preceding the compliance re- view. In November and Decem- ber, agency officials reported non-English speaking drivers on four occasions, and in one instance, the driver was unable to understand English signs and signals sufficiently. Numerous vehicle maintenance violations also were recorded during those inspections. During a Sept. 28 in- spection, FMCSA found an exhaust leak under the cab, an inoperable mandatory lamp and a failure to meet onboard recording device information requirements. There are currently 13 par- ticipants in the three-year pro- gram set to end in October. FMCSA is pending decision on admitting two additional applicants and has dismissed 14 others.
