When you enter upon someone's property, like a warehouse dock, you become an invitee and the property owner has certain respon- sibilities to you. One is to protect you from known dangers on the property. As an employer he has the obligation to protect his employ- ees while they are at work. One of the ways an employer can protect his employees is to limit entry on his property of weapons or drugs. He should post a notice that they are not allowed and a notice that all vehicles and/or persons on the property are subject to searches. Yes, he can do that. When you are notifi ed of a possible search and enter the property, you are agreeing to the possibility of a search by your presence. However, without a noticeable posted notice by the shipper and opportunity to decline the search before entering the property, you could reasonably fi le a police report for trespass against the guard. The difference between the gov- ernment and private security guards is the government may force a search on you, the security guards may not.
