4 • JUNE 2012 • WORLD FENCE NEWS Editor's Corner Fall prevention violations can lead to big OSHA fines –why chance it? A fence contractor buddy of ours recently had the unfortu- nate and expensive experience of being fined by OSHA for vio- lations which resulted from an inspector driving by a baseball backstop they were installing and busting them for not following the agency's fall protection and avoidance regulations. It ap- peared they were not wearing their safety harnesses (even though they were in the truck) and also had improperly (and ad- mittedly unsafely) propped a tall ladder against the structure. After the steam stopped pouring out of his ears, the con- tractor visited with OSHA and was able to have the hefty fine re- duced somewhat after explaining that the crews are instructed to use all required safety equipment, and in fact had it with them. They just suffered a brain freeze. At the same time, the OSHA official said that the agency is very concerned about fall protection violations, because they are one of the leading causes of serious injuries on construction sites (and other work sites). Basically, OSHA requires employers to set up the workplace to prevent employees from falling off of overhead platforms, elevated work stations or into holes in the floor and walls. OSHA requires that fall protection be provided at elevations of four feet in general industry workplaces, five feet in shipyards, six feet in the construction industry and eight feet in longshoring operations. In addition, OSHA requires that fall pro- tection be provided when working over dangerous equipment and machinery, regardless of the fall distance. There is a wealth of information available on fall protection and avoidance both from OSHA itself and from private safety consultants. You should obtain good reliable information and in- corporate it into your company's safety program and tool box talks. It will help your employees know the regulations and ad- here to them, as well as help avoid costly fines and, more im- portant, injuries and even deaths of your workers.
