Opponents argue the provisions would stamp out state-level driver pay reform efforts. – James Jaillet Bill nixes mandated breaks, delays ELDs for livestockers A bill that would exempt carriers from state laws requiring paid meal and rest breaks for drivers was passed by the House Appropriations Committee last month. The legislation also offers a one- year delay to livestock and insect haulers from compliance with the electronic logging device mandate. The 31-20 party-line vote advanced the bill to the full House for consideration. The measure is an appropri- ations bill that would fund the U.S. Department of Trans- portation through the 2018 fiscal year. It also would require the Federal Motor Carrier Safety Administration to adopt reforms to its Compliance, Safety, Accountability carrier safety rating system before pro- ceeding with a Safety Fitness Determination rulemaking. The agency in March with- drew its SFD rule proposal issued in January 2016. At press time, the Senate was set to unveil its 2018 DOT appropriations package. The meal and rest break provisions in the House bill are a part of a continued push at the national level to rein in states' ability to regulate drivers' work schedules and, to an extent, their pay. The provision would reinforce the federal government's authority in regulating drivers' work schedules as established by the 1994 Federal Aviation Admin- istration Authorization Act.
