He was in the right lane, traveling 20 mph slower than the posted 65 mph due to the inclement weather. Doe moved to the left lane and had just passed a pickup crawling at 35 mph when he saw a Mer- cedes sedan shooting across the median and straight toward him. He immedi- ately spun the wheel right and avoided a collision. Doe's trailer, however, cracked loose from his tractor and landed on its side in the ditch. Unscathed, the Mercedes sedan zipped off. Doe later received a preventable acci- dent warning from his carrier, which he contested. Who's in the right? VERDICT: The Na- tional Safety Coun- cil's Accident Review Committee ruled in Doe's favor. He could not have antic- ipated the Mercedes' unsafe maneuver and avoided being sideswiped thanks to his quick reflexes. Evading one crash for another: Preventable or not?
