The House voted June 9 to add an
amendment to its version of the U.S.
Department of Transportation's an-
nual funding bill to stop the Federal
Motor Carrier Safety Administration
from increasing the required mini-
mum amount of liability insurance
for carriers.
FMCSA earlier this year an-
nounced its intentions to seek a
rulemaking to increase the
current $750,000 minimum.
DOT said in its most recent
significant rulemakings report
that FMCSA could publish a
proposed rule as early as No-
vember to raise that amount.
FMCSA said in a report
issued earlier this year that
if the $750,000 minimum
liability insurance amount
had kept up with inflation, it
would be $1.62 million.

tion and the American Truck-
ing Associations reject the
agency's claims, citing studies
that show just 1 percent of all
crashes exceed $750,000 in
claims.

unanimously approved HB 7175,
which would permit insti-
tuting tolls if building a new
highway or adding capacity to
an existing one. The bill also
would permit heavy trucks to
exceed the maximum gross
vehicle weight limit by up to
550 pounds to compensate for
the added weight of auxiliary
power units and other idle
reduction technologies.
CALIFORNIA-BASED drivers
working for Georgia-based
carrier Affinity Logistics were
not independent contrac-
tors, as the fleet argued, but
were employees due to the
control the carrier had over the
drivers' work, the 9th Circuit
U.S. Court of Appeals in San
Francisco ruled last month. The
appeals court overturned an
August 2012 ruling by a lower
court that held the drivers
were independent contractors.
