LEGAL LANE relax. Truck stops usually focus on the high-volume issues like oil changes, tire repair/replacement and the overall routine maintenance. Normally they do not want your truck taking up a bay for several days, which prevents them from their high-volume repairs. Some states require written estimates before any repair work can begin, but most shops provide estimates whether they are required to or not. Some states also limit the percentage amount the bill can go over the estimate. Illinois, for ex- ample, says the bill must not exceed the estimate by more than 10 percent under its Automotive Repair Act. If for any reason you do not or cannot pay for the repairs to your truck, the shop may be legally entitled to keep your truck. They can do this by fi ling a mechanic's lien, which is a legal claim against property that has been repaired or improved by their work and parts. If your $100 repair is not paid, the shop may keep your truck. They may eventu- ally sell your $100,000 truck to recover their costs, but you will get the left over money, if there is any. To get a mechanic's lien, the shop must provide notice to the vehicle owner as to what parts and labor were provided and fi le the same with the court clerk in the county where the vehicle is located. All states have some form of unfair and deceptive acts and practices laws, or UDAP. These UDAP laws address details of the pre-work estimates as well as the use of rebuilt parts.
