May 2018 | Overdrive | 15 The U.S. House last month was set to discuss two measures for consideration with its version of the Federal Aviation Administra- tion reauthorization bill, which had been scheduled for debate in late April. The first measure, brought by Rep. Jeff Denham (R-Calif.), would block states from enforc- ing laws that require carriers to provide drivers with paid meal and rest breaks. The legislation, which also would protect carriers against court-ordered payouts to drivers for nondriving tasks, was backed by the American Truck- ing Associations and the Western States Trucking Association. The other measure, from Rep. Jim Duncan (R-Tenn.), would institute criteria for brokers and shippers to use in hiring a carrier. The amendment would protect them from liability in hiring carriers if they verified the carrier meets certain criteria. Another amendment filed by Rep. Rick Crawford (R-Ark.) would have allowed the Federal Motor Carrier Safety Admin- istration to proceed directly to issuing a proposed rule on hours of service regulation changes, rather than having to publish an advanced notice of a proposed rulemaking first. The provision, which was intended to shave months off of any hours reforms taken up by FMCSA within two years of the FAA bill's enact- ment, was withdrawn before it was brought to a vote on the House floor.
