Fence ordinances from around the country As part of an ongoing and long- standing series, World Fence News of- fers this "snapshot" of building ordinances which affect fence installa- tions from municipalities across the United States. This information was taken from official sources, but you should always consult the appropriate building departments where you plan to work for specific requirements. Portland, Oregon A building permit is required when building a fence taller than six feet. The height is measured from the ground where the posts or sup- ports enter the ground to the top of the fence, including any lattice, posts or any other material added to the top. Fences under six feet tall do not need a building permit but may need a zoning permit, depending on where the fence will be located on your lot. The building permit will be re- viewed under provisions in the Resi- dential Specialty Code (formerly the One and Two Family Dwelling Spe- cialty Code) based on the 2003 IRC. The following information must be submitted when applying for a per- mit to construct a fence.
