"If an owner-operator misses work to be tested, that makes it hard to pay their bills," said Andrew King of the Owner-Operator Inde- pendent Drivers Association. The Federal Motor Carrier Safety Administration and Fed- eral Railroad Administration hosted the listening sessions. Truck drivers at the second session echoed comments on narrow screening proto- cols from the first meeting, where Dr. Alan Lankford of SleepSafe Drivers urged that any regulation "should take the approach that [risk factors like neck size and body mass index don't] mean you have sleep apnea. We need to make sure that the people behind the wheel understand they are not 'guilty until proven innocent.'" Trucker Bob Stanton of Truckers for a Cause, a sleep apnea patient support group, recommending extending the "pre-rule" comment period. OOIDA also has asked both agencies to extend the dead- line 60 days from its original date. "We still haven't solved the problem of how to use a CPAP in a non-APU truck in a no-idle state such as Califor- nia," Stanton said. "Plus, you can't use a CPAP below 45 de- grees because CPAP-induced hypothermia is a real problem. ... Oral appliances are going to have to be an option." Insurance coverage is also an issue: companies don't always see a sleep study as a medical necessity, Stanton said. King said a 2004 FMCSA study stated there was no association be- tween sleep apnea and crashes, and the American Trucking Associations' Megan Bush suggested sleep apnea treatment's effectiveness undercut the need for regulation.
