SCENARIO: Driver John Doe was stopped at a red light on a divided highway at 6:30 a.m., heading north- bound in the left lane. Stopped to the lane right of Doe was a pickup truck. When the signal changed and Doe began accelerating, he noticed the road narrowing from two northbound lanes to the one lane Doe was in. The pickup driver accelerated heavily to try to get ahead of Doe before the merge. The driver pulled in front of Doe's truck, but swiped Doe's front fender, causing about $800 in damage to the tractor's front right fender and about $500 in damage to the pickup's left rear fender. The police cited the pick- up driver for an unsafe lane change. Doe's carrier, however, cited him with a preventable accident warning. Doe contest- ed. Who's in the right? VERDICT: Preventable. The National Safety Council's Acci- dent Review Committee ruled Doe should have expected the pickup driver might try to zip ahead of him. Doe should have anticipated, by watching his mirrors, that he would need to yield quickly. – Overdrive staff KENTUCKY-BASED truck driver Wil- liam Eichhorn was placed out of service after being stopped by state police and found to be transporting passengers, including two children without safety restraint devices, without written motor carrier authorization. Offi cers also found a gallon jug of beer, along with drug paraphernalia. Eichhorn failed a fi eld sobriety test. VITALII VITIUK pleaded guilty to conspiracy to unlawfully produce iden- tifi cation documents to obtain Pennsyl- vania commercial and noncommercial learner's permits and driver's licenses. Vitiuk and Volodymyr Kurylo operated under the auspices of VN Trucking and provided false residency documents to out-of-state students.
