68 • SEPTEMBER 2014 • WORLD FENCE NEWS As part of an ongoing and long-standing series, World Fence News offers this "snapshot" of build- ing ordinances which affect fence in- stallations from municipalities across the United States and Canada. This information was taken from official web sites, but you should always con- sult the appropriate building depart- ments where you plan to work for spe- cific requirements. City of Woodbury, Minnesota A fence up to 6 feet in height may be erected on the rear lot line, the side lot lines and return to the nearest front corner of the principal building. A fence not exceeding 4 feet in height may be erected on the side lot lines forward of the front corner of the principal building. Fences in excess of 30 inches in height extending across front yards are not permitted in residential platted areas. No fence shall be constructed in a manner that would block the view of vehicular traffic or restrict snow plow- ing of streets. Fences may be placed up to prop- erty lines. It is the owner's respon- sibility to verify the location of the property lines. The side of the fence considered to be the face (the finished side) shall face adjoining property. Barbed wire fences are not per- mitted in platted areas. All fences shall be properly main- tained with respect to appearance and safety. Swimming pools must be protect- ed by a fence at least 4 feet high, with a self-closing, self-latching lockable gate, built so that a 4-inch sphere can- not pass through. It is suggested to have a surveyor locate property lines before installing fences. The city does not have survey- ors on staff to perform this service. Garland, Texas A fence permit is required any time a fence is being replaced or in- stalled on a corner lot; if you have a swimming pool in the rear yard; if you are changing the height, location, or materials of the fence (going from chain link to wood or from wood to wrought iron, etc.); or if you are in- stalling a fence where one has never existed before. Many subdivisions have specific requirements for fencing materials. Fence ordinances from around the country Some of these rules are city ordinanc- es and some are private deed/HOA restrictions. The city will enforce city ordi- nances, but it is the homeowner's re- sponsibility to know and abide by pri- vate deed/HOA restrictions. Note: If you are installing a fence over your driveway and wish to install gates that swing open, you may not al- low those gates to swing into the right- of-way (or into the alley). When installing a fence on a cor- ner lot with an alley (for fencing that you cannot see through, i.e., wood privacy fences, vinyl fencing, stone or brick fencing) or street to street access, you are required to install what we re- fer to as a "visibility clip" to avoid ob- structing the visibility triangle.
