Webster Groves, Missouri A fence permit is required for all new and replacement fences. • Fences within historic districts have additional submittal and review requirements. • Fences must be located entire- ly upon the private property of the person constructing or causing the construction of the fence, unless the property owner adjoining agrees in a written notarized statement that a fence may be erected on the division line of both properties. • Repairs to an existing fence do not require a permit. A repair is the replacement of a portion of a fence which is less than 25% of its total linear distance, or 300 sq. ft. of fence surface, whichever is less. • Repairs must be made in the same material, at the same height, and same location as the original fence. • Fences must be at least 12 inches from a public sidewalk or street. • Issuance of a permit should not be construed as certifying that prop- erty boundaries, fence locations, or easements are correct. An application for a fence permit must include the following: – Completed fence permit appli- cation. – One copy of a survey or scaled drawing showing the location of all property lines, structures, and the lo- cation and dimensions of the existing and proposed fencing. – A description of the fence ma- terials, height, and type (e.g. sketch, brochure, etc.) Height limitations Fence heights are measured from the top of the fencing material to the ground. Fence posts may be up to 6" taller. Maximum heights of fences are as follows: – 4 feet high anywhere on the property, except within 30 feet of a street intersection, in which case the maximum height is 2 feet with city approval. – 6 feet high in any part of the rear yard. – 8 feet high within the buildable area (inside the front, side, and rear yard setbacks) – 8 feet high between the proper- ties zoned residential and commercial or industrial, and along residential. Denver, Colorado Historic landmark status Any project that involves changes to the exterior of landmark structures or properties in historic landmark dis- tricts must be reviewed by Landmark Preservation staff before you begin. The appropriate zoning, building, curb cut, or revocable permits needed for the project will be issued only af- ter design review has been completed and the project has been approved. Zoning Zoning establishes standards for things such as the size and location of structures and acceptable uses for your property. Before you begin con- struction, you need to be sure your project is in compliance with the Den- ver Zoning Code. Parkways Any project that encroaches on a designated parkway setback will need to undergo parkways review. Certain parkways and boulevards are specifi- cally designated by ordinance to pre- serve their unique character. Each designated parkway has its own right-of-way width and regula- tions of setback distance of structures and signs. Building code The Denver Building Code pro- vides minimum standards for build- ing in order to safeguard public safety, health and welfare. The permitting and inspection process ensures that all home projects meet these standards and that all dwellings are safe and habitable at the time of construction. Location of existing sewer lines If you plan to build a new struc- ture over or within 2 feet of an ex- isting sanitary sewer, you will need to replace the sanitary sewer with approved materials. A plumbing con- tractor can help you locate the sewer lines on your property. Location of utilities When designing your project, you need to know where utilities are lo- cated. You cannot build over existing utilities. Before you dig, contact the Utility Notification Center of Colo- rado at 800-922-1987 or 811 to mark underground utilities for your project. Fences should not be constructed in the adjacent property or in the pub- lic right-of-way. All retaining walls or fences must be 6 inches back from the public sidewalk, regardless of where the property line is. If your property is a designated landmark or historic district property, landmark design review and a zoning permit are required regardless of the height or location of the fence. If your property is on a designated parkway, parkways review and a zon- ing permit are required regardless of the height or location of the fence. If your property is on a floodplain or if you are digging 2 feet from the sewer line, a wastewater permit is re- quired. If your fence is all or part mason- ry and the masonry measures more than 4 feet in height from the footer (not from grade), a building permit is required.
